Should one choose a Part 9 Debt Agreement from our range of debt solutions, they are not listed as bankrupt. It is listed as a Part 9 Debt Agreement. In ACCC vs FSA Group the statement that a Debt Agreement was an alternative to bankruptcy was disputed by the ACCC but dropped from the final settlement. This position is in line with comments by the Attorney General Philip Ruddock when the 2007 amendments were made when he stated that “Debt agreements were introduced in 1996 as a relatively low cost, informal and flexible alternative to bankruptcy”. It should be noted that while a Debt Agreement will be removed after 5 years or 2 years after termination whichever is longer, Bankruptcy remains on the NPII forever.
